GENERAL TERMS AND CONDITIONS OF SALE
1°) Scope of application:
These general terms and conditions apply to the services provided by Bellidays Travel Tours in the context of the operation of its road passenger transport licences, transport of parcels under 3.5 tonnes, bicycle rental and organisation of tourist services such as guided tours.
2°) Definition of the service:
The service includes the reservation, the provision of a vehicle in perfect working order, a qualified driver and/or guide, professional liability insurance for the people transported, fuel, kilometers and time according to the quote, departure and return to the garage.
3°) Determination of the price:
A fixed price is agreed in the special conditions. This package includes the driver’s and/or guide’s meal, in case of service between 12 p.m. and 2 p.m. or 8 p.m. and 10 p.m. (package €18), the overnight stay if overnight (€150).
It does not include (except as indicated in the special conditions) entrance fees to paid monuments, the extra hour (€90 for a driver; €120 for a driver-guide and €90 for a private guide) and additional km (€2.50/km extra), additional services not mentioned. These add-ons will be added to the price. The flat rate is increased by 25% between 8 p.m. and 7 a.m. or on Sundays and public holidays in proportion to the driving time. Any changes to the schedules and mileage of the transport will change the amount of the quote. In the event of availability, any hour started will be invoiced.
The prices shown in our price lists or in the quotes are established according to the economic conditions known at the time of their development.
Consequently, Bellidays Travel Tours reserves the right, and the right, to modify its rates in the event of a fluctuation in the determining elements of its composition, and in particular the price of fuel.
The litigation of the services of the company Bellidays Travel Tours, or any body mandated by it, following a delay in payment, will result in the payment, in addition to legal interest and any recovery costs, of a lump sum compensation of €50, as damages pursuant to the provisions of articles 1152 and 1226 of the Civil Code relating to the penalty clause.
Route extensions or detours for reasons beyond the customer’s control (works, diversion, bad weather, etc.) will not be invoiced.
These circumstances do not constitute a reason for a claim entitling the holder to a refund or reduction of the price, or compensation.
The rates indicated are valid until December 31, 2025 and are subject to change without notice.
4°) Booking procedures:
Reservations can be made by phone or email at least 24 hours before the departure time of the service (except for special conditions) and subject to the availability of vehicles.
The client is informed that Bellidays Travel Tours reserves the right to subcontract all or part of the service, which he unconditionally and expressly accepts.
5°) Payment of the price:
A minimum deposit of 50% of the originally agreed package price is paid at the time of booking.
The balance of the payment, unless agreed by the company Bellidays Travel Tours, is paid before the service (except in the context of a subscription contract).
In any case, the Booker and Signatory of the Order Form is responsible for his or her payment jointly and severally with the User.
For long-term services and for customers with accounts, the payment of invoices or statements may be subject to periodic payment according to special conditions.
Credit card payments are accepted. Bank charges relating to the payment order for international transfers are the responsibility of the customer.
In the event of non-payment on the due date, our invoices will automatically and without prior notice of default bear interest at the legal rate as well as a fixed indemnity of €50 for recovery costs.
6°) Termination/Cancellation:
In the event of termination of the contract by the customer for any reason, more than one month before departure, he will be fully refunded. In the event of cancellation less than one month before the date of the service, the deposit will be kept with our services. Bookings that are not cancelled at least fourteen days before the service, or in the event of the client’s absence at the pick-up, will be charged the total fixed price initially agreed.
7°) Unavailability:
In the event that the carrier is unable to provide the vehicle or guide provided for in the contract, the sums already paid will be reimbursed in full without recourse or compensation for the damage caused. However, the deposit will be retained if both parties agree to book another service.
In the event of a breakdown or accident during the service making the vehicle unavailable, the amount of the service will be calculated in proportion to the time spent, without recourse or compensation for the damage caused.
Bellidays Travel Tours is not responsible for any delays or cancellations due to weather or traffic conditions.
8°) Safety and damage:
The driver must comply with the highway code and the regulations on daily driving and rest times. It is forbidden to violate these rules even at the request of the customer.
The people transported will let the driver open and close the doors; In the event of damage to the interior equipment or other damage inflicted on the vehicle, for example when the doors are opened unexpectedly, the damage caused will be borne by the customer, with a minimum flat rate of €150.
Smoking is not allowed inside the vehicles; The driver is instructed to stop to allow smokers to relax if they wish. If the driver notices that the customer is committing an offence, he is instructed to stop the service in progress immediately. This judgment will not give the right to any reimbursement or compensation.
No animals are allowed in the vehicles except in a cage or an airtight container provided for this purpose or by prior agreement.
9°) Insurance and liability:
In accordance with the law, passengers transported by our vehicles are insured against possible accidents within the limits of the carrier’s responsibility.
Any loss, theft or damage must be the subject of a written report with the driver and a report to the police.
Repatriation costs in the event of illness or death remain the sole responsibility of the client.
Under no circumstances shall Bellidays Travel Tours’ liability extend to direct or indirect damage suffered by the customer as a result of the possible delay of a vehicle.
10°) Force majeure:
Bellidays Travel Tours’ liability cannot be implemented if the non-performance or delay in the performance of any of its obligations described in these general terms and conditions of sale results from a case of force majeure. As such, force majeure means any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.
11°) Disputes:
Subject to the legal provisions, any dispute that may arise from this contract is under the exclusive jurisdiction of the Commercial Court of Rennes.
This contract is subject to French law.
